Terms and Conditions of Business (Effective As Of 2nd September 2024):
. Definitions
- "Service": Refers to the dog walking and let out services provided by Bark Side Of Midlothian Limited.
- "Client": The person or entity purchasing the Service.
- "Walker": Any individual employed or contracted by Bark Side Of Midlothian Limited to perform the Service.
- "Dog(s)": The canine pet(s) owned by the Client and receiving the Service.
2. Services Provided
- Bark Side Of Midlothian Limited agrees to provide dog walking and/or let out services as per the Client’s requirements, subject to availability and agreement on terms.
- The Service includes walking the Dog(s), providing fresh water if required, and ensuring the Dog(s) are returned safely to the Client’s property.
- Any additional services (e.g., feeding, medication administration) must be pre-arranged and may incur additional charges.
3. Service Hours and Availability
- Bark Side Of Midlothian Limited will strive to accommodate all requests but does not guarantee availability for all times requested.
- The Client agrees to provide at least 24 hours notice for cancellations or rescheduling. Failure to do so may result in the full service charge being applied.
4. Fees and Payment
- Fees for the Service will be charged according to the rates set out on Bark Side Of Midlothian Limited’s website or as agreed in writing with the Client.
- Payment must be made in full by 30 DAYS FROM INVOICE. Accepted payment methods include BACS transfer.
- Late payments may incur a late fee of 20% of the outstanding amount per 30 days, or service suspension until payment is received.
5. Client Obligations
- The Client must ensure that their Dog(s) are up-to-date with vaccinations, flea treatments, and worming. The Client must provide proof of this to Bark Side Of Midlothian Limited.
- The Client must inform Bark Side Of Midlothian Limited of any medical conditions, dietary needs, or behavioural issues relevant to the Dog(s) that may affect the Service.
- The Client is responsible for ensuring that their Dog(s) are fitted with a suitable collar and lead, and that their property is safe and secure for the Service to be performed.
6. Health and Safety
- Bark Side Of Midlothian Limited reserves the right to refuse or discontinue Service if the Dog(s) display aggressive or dangerous behaviour, or if the Walker believes the Dog(s) pose a risk to their safety or that of others.
- In the event of a medical emergency involving the Dog(s), Bark Side Of Midlothian Limited will attempt to contact the Client immediately. If the Client cannot be reached, Bark Side Of Midlothian Limited is authorized to seek veterinary care at the Client’s expense.
7. Liability
- Bark Side Of Midlothian Limited is fully insured for public liability. However, Bark Side Of Midlothian Limited shall not be liable for any loss, injury, or death of the Dog(s) arising from pre-existing health conditions, unforeseeable accidents, or any situation beyond the control of Bark Side Of Midlothian Limited.
- The Client agrees to indemnify Bark Side Of Midlothian Limited and its Walkers against any claims, damages, or expenses arising from the Dog(s) during the course of the Service.
8. Holding of Keys
- Bark Side Of Midlothian Limited may hold keys to the Client’s property for the purpose of providing the Service.
- Keys will be stored securely when not in use and labelled in a manner that does not directly identify the Client's property.
- In the event of loss or damage to the keys while in Bark Side Of Midlothian Limited’s possession, Bark Side Of Midlothian Limited will cover the reasonable cost of replacement keys and/or locks, up to a maximum liability of £30.
- Bark Side Of Midlothian Limited shall not be liable for any indirect, consequential, or incidental loss or damage arising from the loss or misuse of keys.
9. Cancellation and Termination
- The Client may cancel the Service with 24 hours notice without incurring a fee. Cancellations with less than 24 hours notice may be charged at the full rate.
- Bark Side Of Midlothian Limited reserves the right to terminate the Service with immediate effect if the Client breaches any of these Terms and Conditions or if the Dog(s) are deemed unmanageable or dangerous.
10. Data Protection
- Bark Side Of Midlothian Limited will collect and process personal information provided by the Client in accordance with the Data Protection Act 2018 and the UK GDPR.
- Personal information will be used solely for the purpose of providing the Service and will not be shared with third parties without the Client’s consent.
11. Governing Law
- These Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland.
- Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Scotland.

Agreement
By engaging Bark Side Of Midlothian Limited to provide dog walking and/or let out services, the Client agrees to be bound by these Terms and Conditions.
